SpaceX Urges South Africa’s ICASA To Reconsider Proposed Satellite Spectrum Fees

Space Exploration Technologies Corp. (SpaceX) has submitted formal representations to South Africa’s Independent Communications Authority (ICASA) over proposed changes to the country’s radio frequency spectrum fee framework.

The submission, filed on June 29, 2026, follows ICASA’s publication of proposed amendments to the Radio Frequency Spectrum Fees Regulations in May. SpaceX said it is looking to expand Starlink’s LEO broadband services in South Africa through a local subsidiary.

Signed by SpaceX Senior Director of Market Access and Development Ryan Goodnight, the submission welcomed ICASA’s consultation process. Still, it raised concerns about the proposed fee structure and how spectrum charges would apply to satellite operators.

SpaceX supported ICASA’s proposal to introduce a frequency factor into the Gateway Earth Station fee formula, saying this would help prevent high-throughput satellite systems using higher frequency bands from being unfairly penalised. However, the company argued for alternative approaches, including a flat annual licence fee, saying bandwidth-based charges do not accurately reflect the economics of satellite operations.
It also asked ICASA to apply fees on a per-licence basis rather than charging separately for each earth station site.

On user terminals, SpaceX backed blanket licensing for terminal networks, including Earth Stations in Motion (ESIMs) used on aircraft and vessels. The company also asked ICASA to clarify how spectrum fees would be allocated across disaggregated supply chains, particularly where foreign satellite operators work with local service providers. SpaceX said greater clarity would help avoid the possibility of the same service being charged twice.

SpaceX also urged ICASA to extend the frequency factor table beyond 50 GHz to cover emerging E-Band and millimetre-wave technologies. It called for licences to run for at least 10 years, saying longer terms would give investors greater certainty.

SpaceX also pointed to the wider regulatory requirements that satellite operators must consider when entering the South African market. It asked ICASA to provide clear, consolidated guidance on requirements for foreign satellite providers, including establishing local entities, the 30% Historically Disadvantaged Group (HDG) equity requirement, and compliance with the ICT Sector Code under Broad-Based Black Economic Empowerment (B-BBEE) legislation.

The company has also asked to make oral representations should ICASA proceed with public hearings on the proposed amendments.
Overall, SpaceX’s submission calls for a spectrum fee regime that it believes better reflects the technical and commercial realities of satellite broadband, while providing greater clarity for international operators seeking to invest in South Africa.
