OTT Streaming: Regulating Platforms, Content And Use Of Consumer Data In Africa

The regulation of streaming services in Africa is still in its early stages, marked by promising initiatives and ongoing challenges. As the continent’s digital transformation continues, the need for robust, adaptable, and inclusive regulatory frameworks will become even more pressing.

The OTT Streaming Summit – Africa 2025, taking place from 18 – 19 February 2025 at The Capital 15 On Orange, Cape Town, South Africa, will provide a platform for stakeholders to discuss these issues as the sector continues to expand, regulators, platforms, and stakeholders grapple with the challenge of establishing frameworks that ensure fair competition, protect user data, and maintain cultural integrity.

One of the critical issues in regulating streaming platforms is ensuring fair market competition. Traditional broadcasters often face uneven regulatory burdens compared to over-the-top (OTT) platforms. While broadcasters are subject to stringent licensing and local content quotas, many streaming services operate with minimal oversight, allowing them to scale quickly and dominate the market.

In response, several African nations are exploring strategies to create a more balanced regulatory environment. South Africa, for instance, has proposed amendments to its Electronic Communications Act to extend certain regulations to OTT platforms. Similarly, Nigeria’s National Broadcasting Commission (NBC) has outlined plans to regulate streaming services within its borders. However, implementing these measures without stifling innovation remains a delicate balancing act.

Mr. Benjamin Pius, CEO of Broadcast Media Africa, underscores the significance of a collaborative approach in shaping the regulatory landscape for streaming services in Africa. He notes, “As streaming becomes a dominant force in the African media ecosystem, it is essential that regulators, industry stakeholders, and technology providers work together to create equitable, inclusive, and forward-looking frameworks. This is not just about regulation; it’s about setting the stage for a thriving digital future that benefits consumers and creators alike.”
